THESE TERMS OF AGREEMENT TO BE THE CONCERN OF THE USER

• It is an urgency to bind the user of this site, either mobile application or portal web, into a Nondisclosure agreement considering the high confidentiality of the data shows or transmitted to or trough this site;
• This agreement is aimed to protect the data shows or transmitted to this site, and it is a prohibited action to spill, transfer, confess, exchange, or transact the data to other party without any concern and approval from the data owner/or SCG top management;
• User is aware that the access to this site is prohibited without accepting the nondisclosure agreement, and it has become the standard procedure for getting the access whether the access is performed due to the willingness of the user himself, due the scope of work of the user, or by any possible reason causing the user to access this site.

CONFIDENTIAL INFORMATION

• Every information that are shown at, provided by, or transmitted into this site are generally confidential, and the receiver must conduct such necessary and sufficient action that is referred to the general treatment of confidential information and/or specific treatment stipulated in this agreement;
• Every information that are input or transmitted into this site is belong to the ownership of PT. Kokoh Inti Arebama, Tbk. or generally is owned by SCG Corp. and therefore, the predicate of the “Receiver” is always be entitled to the user;
• Receiver must, by all means, and sufficient effort, prevent any illegal disclosure, transmission, or exchange of such confidential information, unless, such confidential information are:
  • Basic information or terms in industrial or trading terms and is publicly known and accepted;
  • Has been previously made available in the public;
  • Trough a proper approval, ordered to be disclose to another party in which listed or mentioned in such approval;
  • Requested by government body and such request has coercive power, and make such nondisclosure treatment conducted by receiver is an action potentially against the prevailing law and regulation;
  • Requested by the certain level of SCG management and is used to determine such corporate decision;
• The treatment for confidential information must also be enforced for the derivative information and logical consequences of the existence of such confidential information which may affect the business performance of PT. Kokoh Inti Arebama, Tbk., and SCG Corp in general;

INTELLECTUAL PROPERTY

• By granted the access to this site, and access to the confidential information, including but not limited to transmitting data to this site, does not constitute the transfer of such intellectual property right which may be engaged to this site;
• Interface, formula, coding, and any idea has become the element of composing of this site reserved the protection of intellectual property, and any action, such as but not limited to the reproduction, imitating, or any action causing the establishment of similar application or web portal, or potentially harm the application or web portal is strictly prohibited;
• The breach of the stipulation above is against the law and may affect a strict punishment provided by prevailing law and regulation;

GENERAL CONCEQUENCES OF ILLEGAL DISCLOSURE OF INFORMATION

• User realizes the illegal disclosure of the information is a breach of contract, and may also constitute the breach of law;
• Any user illegally discloses the information will banned to access this site;
• if the user is the employee of PT. Kokoh Inti Arebama, Tbk. or SCG Group Company, then, the disciplinary code will be enforced to the employee, and the punishment may be varied according to the prevailing regulation apply to each company;
• the enforcement of disciplinary code will not eliminate the enforcement of law and regulation prevailed in the Republic of Indonesia if such action is potentially against such law;

INTERPRETATION AND PREVAILING LAWN

• This agreement is interpreted based on the law of the Republic of Indonesia;
• If one of the terms of this agreement become impractical or against the stipulation of the newly regulated law and regulation, such terms may be automatically adjusted according to the prevailing law or be eliminated, but such adjustment or elimination will only be applied to those particular terms, and not affect the applicability of this agreement in whole;

ACKNOWLEDGEMENT AND ACCEPTANCE

• User is declared has previously registered and input the data that is true, and accountable;
• user has read the terms carefully and declare understand the meaning of each term of this agreement;
• by clicking “Agree” button/put checklist in the box user understand and accept to be bind into this agreement and entitled to any possible consequences provided by this agreement;
• the acceptance of the user is done in fully awareness and without any threat from anyone.
